Terms of Service

These Terms of Service (the "Terms") set out the conditions for using NobodySurf, provided by REBLUE INC. ("we", "us"). By using the Services, you ("you", "users") agree to these Terms.

1. Services covered

These Terms apply to the NobodySurf apps for iPhone, iPad, Apple TV and Android TV (once released), and to our website (https://nobodysurf.com) (together, the "Services"). Purchases at NobodySurf Shop (https://shop.nobodysurf.com) are governed by that shop's terms.

2. Relationship with the app license

Your use of apps obtained from the App Store is governed by Apple's Licensed Application End User License Agreement (Standard EULA). These Terms set out the conditions for the services provided through the apps and the website. If they conflict, Apple's Standard EULA prevails as to the license of the apps.

3. Age

The Services are intended for people aged 13 or older. If you are a minor, please use the Services with the consent of a parent or other legal guardian.

4. Accounts

  1. You can create an account by signing in with Apple or Google
  2. You are responsible for managing your own account
  3. You can delete your account at any time in the app's Settings. How we handle your information when you do so is described in our Privacy Policy

5. Supporters Club

  1. Supporters Club is a paid membership offered as an auto-renewable App Store subscription. The price and period are shown on the purchase screen
  2. Payment is charged to your Apple Account at confirmation of purchase. Your subscription renews automatically, and you are charged for the renewal, unless you cancel at least 24 hours before the end of the current period
  3. If a free trial is offered, it converts to a paid subscription unless you cancel before the trial ends
  4. To cancel, use the subscription settings of the App Store. Deleting your account does not cancel your subscription automatically
  5. Refunds are handled by Apple under its policies. We cannot process refunds
  6. Membership benefits may change, for example to improve the Services. We will announce significant changes in the Services in advance

6. Videos and their rights

  1. Most videos featured in the Services are published on YouTube or Vimeo, and the copyright and other rights in them belong to their creators or other rights holders
  2. Playback of YouTube videos is subject to the YouTube Terms of Service. By watching YouTube videos in the Services, you agree to be bound by the YouTube Terms of Service
  3. Videos may become unavailable without notice due to the circumstances of their rights holders or hosts

7. Playlists you create

  1. You retain the rights to the names, descriptions, cover images and other content of the playlists you create
  2. You grant us permission to display and use your public playlists to provide and promote the Services
  3. Your playlists must not infringe the rights of others or violate Section 8
  4. We may make private or remove, without prior notice, any content we determine violates these Terms, including after receiving a report

8. Prohibited conduct

When using the Services, you must not:

  1. Violate laws or public order and morals
  2. Infringe the rights of us, other users, video creators or any third party
  3. Post defamatory, discriminatory, obscene or violent content
  4. Place an excessive load on our servers or networks, access them without authorization, or interfere with the operation of the Services
  5. Collect content from the Services in bulk by automated means
  6. Impersonate others
  7. Engage in any other conduct we reasonably determine to be inappropriate

9. Suspension

If you violate these Terms, we may suspend your use of the Services or delete your account without prior notice.

10. Changes to and suspension or termination of the Services

  1. We may change the Services, or suspend or terminate them
  2. If we terminate the Services, we will announce it in the Services with reasonable advance notice

11. Disclaimer and limitation of liability

  1. We do not guarantee that the Services fit your particular purpose, that videos will remain available, or that the Services are free of errors
  2. We are not liable for damages you incur in connection with the Services, except where caused by our intent or gross negligence
  3. Notwithstanding the preceding paragraph, where we are liable (including where Japan's Consumer Contract Act applies), except in cases of our intent or gross negligence, our liability is limited to ordinary damages actually incurred by you, up to the amount you paid for Supporters Club in the 12 months before the damage occurred

12. Changes to these Terms

We may change these Terms in accordance with the provisions of the Civil Code of Japan on changes to standard terms. We will announce the changes and their effective date in the Services a reasonable period before they take effect.

13. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The Tokyo District Court has exclusive jurisdiction as the court of first instance over any dispute relating to the Services. If you are a consumer, this does not prevent you from bringing a claim in the court of your place of residence.
